Terms of service.
Please read these terms before using our services. By booking or attending a visit, you agree to them.

1. Acceptance of terms
These Terms of Service ("Terms") are a binding agreement between you ("patient," "you") and RareKare Primary Care ("we," "us," "our") governing your use of our in-person and telehealth services, this website and related platforms.
By booking an appointment, creating a patient portal account, or using any of our services, you acknowledge that you have read and agree to these Terms, our Privacy Policy and our HIPAA Notice of Privacy Practices. If you do not agree, do not use our services.
2. Description of services
2.1 Primary care services
RareKare Primary Care provides primary care through scheduled in-person appointments at our offices in Sugar Land and Cypress, Texas, and through secure video visits, with Dorothy Marie Colón, APRN, FNP-C, a Board-Certified Family Nurse Practitioner. Services include primary care, sick visits, chronic condition management, preventive care, mental health care, women's and men's health including hormone therapy, and medical weight loss.
2.2 Licensing and location
Our provider is licensed in Texas. Telehealth services are available only to patients physically located in Texas at the time of the visit. We verify patient location at each video visit.
2.3 Not emergency services
We do not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use our appointments, portal or contact form for life-threatening conditions.
3. Eligibility and accounts
3.1 Age
You must be at least 18 years old to use our services independently. Patients under 18 require the consent and participation of a parent or legal guardian.
3.2 Account security
You are responsible for keeping your patient portal credentials confidential, for activity under your account, for telling us promptly about unauthorized access, and for providing accurate and complete information.
3.3 Verification
We may require government-issued identification before providing services. Providing false information may result in termination of services.
4. Patient responsibilities
- Provide a complete and accurate medical history, including all medications, allergies and existing conditions
- Follow the agreed plan of care and report adverse reactions promptly
- Attend scheduled appointments or give at least 24 hours notice of cancellation
- For video visits, be in a private location with a reliable connection and be physically in Texas
- Complete recommended laboratory testing and share outside results
- Tell your provider about changes in your health between visits
5. Appointments and cancellations
5.1 Scheduling
Appointments are scheduled online through our booking platform (Tebra) or by phone, based on availability. Both offices see patients by appointment only. Same-day availability is not guaranteed. Confirmations are sent by email and text.
5.2 Cancellation policy
Please cancel or reschedule at least 24 hours in advance. Late cancellations and missed appointments may result in a fee of up to the visit price and may limit future scheduling.
5.3 Provider cancellations
If we must cancel, we will notify you as early as possible and make reasonable efforts to reschedule promptly.
6. Payment and billing
6.1 Fees
Current pricing is on our pricing page. Visits that involve prescribing or managing a controlled substance have a higher visit fee, also listed on the pricing page. Fees are due at the time of service. There are no memberships or subscription plans.
6.2 Insurance
We are in the process of credentialing with insurance plans. Until credentialing is complete, visits are self-pay. Laboratory testing, prescriptions, imaging and specialist care ordered from a visit are billed by those providers, and your insurance may apply. You are responsible for understanding your coverage and for any amounts not covered. See our insurance page.
6.3 Payment methods
We accept cash, major credit and debit cards, and HSA/FSA cards. An itemized receipt is provided for every visit.
6.4 Refunds
Visit fees are non-refundable once the visit has occurred. Refunds may be issued at our discretion for billing errors or services we are unable to provide.
7. Prescriptions and controlled substances
7.1 Prescribing authority
Our provider prescribes under a prescriptive authority agreement with a Texas-licensed delegating physician, as Texas law requires, and decides whether a medication is appropriate for each patient. Prescriptions are issued only when clinically appropriate and in accordance with Texas and federal law.
7.2 Controlled substances
- Prescribed only when clinically appropriate and in line with Texas and federal rules
- May require an in-person evaluation before prescribing
- Schedule II medications are not prescribed
- Schedule III through V prescriptions are limited to a 90-day supply before physician consultation, as Texas law requires
- Subject to Texas Prescription Monitoring Program checks where required
- May require periodic monitoring and a controlled substance agreement
7.3 No guarantee of prescription
Booking a visit does not guarantee that any particular medication will be prescribed.
8. Medical records
We maintain electronic medical records in compliance with HIPAA and Texas law. You may request access to your records, request amendments and receive an accounting of certain disclosures. Requests must be in writing; reasonable copying fees may apply. See the HIPAA Notice.
9. Telehealth consent and limitations
9.1 Understanding telehealth
- Video visits have limitations compared with in-person examination
- Physical examination and certain testing cannot be performed remotely
- Technology failures may interrupt or prevent a visit
- You may be directed to an in-person visit at one of our offices, or to other care, when clinically necessary
9.2 Technical requirements
You are responsible for a stable internet connection, a compatible device with camera and microphone, and a private location.
9.3 Conditions not treated by telehealth
- Emergency or life-threatening conditions
- Conditions requiring physical examination, in-office testing or imaging to diagnose
- Conditions outside our provider's scope of practice
10. Disclaimers and limitation of liability
Our website and services are provided "as is" without warranties of any kind. We do not guarantee specific medical outcomes. To the maximum extent permitted by law, RareKare Primary Care and its affiliates are not liable for indirect, incidental, consequential or punitive damages arising from use of our website or from technology failures, data loss or interruption of services. We are not responsible for the acts or omissions of third-party providers such as pharmacies, laboratories or specialists. Nothing in these Terms limits your rights under applicable Texas law, including the right to pursue a medical liability claim.
11. Termination
You may discontinue care at any time. We may end the patient relationship, with appropriate notice and record transfer as required by Texas law, if you violate these Terms, provide false information, behave abusively toward staff, repeatedly miss appointments, or have unresolved unpaid balances.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas. Before initiating formal proceedings, you agree to contact us to attempt an informal resolution.
13. General provisions
We may modify these Terms; material changes are posted on this page. If any provision is found unenforceable, the remainder continues in effect. These Terms, the Privacy Policy and the HIPAA Notice are the entire agreement regarding our services.
